Terms, Conditions & Cancellation Policy

• Price based on number of persons on booking. If the property accommodates more, extra persons may be allowed by agreement and extra charges will apply. If it is ascertained that more than the number of people permitted without prior approval are being accommodated in the property you will be required to vacate the premises.

• All occupants are required to respect the property and it’s furnishings and use the property as a private dwelling only and shall not allow anything to be done at the property, which shall cause damage, be a nuisance or annoyance to the occupiers, owners or neighbouring properties. Tenants are to be considerate to the fact that the property is located in a residential area, so please keep noise levels to an acceptable level especially between the hours of 10pm-7am. Should we receive any complaints or Noise Control is called, or we feel the property is being misused in any way we reserve the right to ask you to vacate the property immediately with no refund.

• Parking is only available for guests. No parking on grass or shared driveways.
• Should we vacate the premises prior to the agreed termination date, no refund will be given.
• Strictly NO SMOKING inside of the house and no pets are allowed on the premises.
• Check in from 2pm, check out 11am unless changed by prior arrangement.

• Whilst the owners strive to maintain all facilities and appliances in full working order, in the event of any malfunction, we will do our best to rectify the problem as soon as possible.

• Visitors – maximum number of visitors allowed to the property at any one time is limited to 4 people.
• STRICTLY NO PARTIES OR FUNCTIONS PERMITTED and no visitors are permitted to stay overnight.
• SECURITY – it is your responsibility to ensure the property is fully locked, windows doors closed etc when you are not at the property.
• Currency – All amounts are in New Zealand dollars.
• In unforeseen circumstances beyond the control of the Landlords/Owners: the Landlords/Owners reserve the right to cancel or alter booking arrangements. In the event of a cancellation the Landlords/Owners shall only be liable for the return of all money received.

Cleaning & Vacating
• Guests agree to keep the premises reasonably clean and tidy at all times, and agree not to remove any chattels from the property. No servicing is included within the nightly rate. Excessively littered and/or dirty conditions at checkout will result in extended housekeeping hours at an additional cost of $40/hour.
• When vacating the premises it is expected that you leave the property in a clean and tidy condition and free of rubbish as it was presented to you. Please ensure all dishes are done and put away and BBQ cleaned (if any). Please ensure all lights are turned off and ALL WINDOWS AND DOORS MUST BE LOCKED SECURELY BEFORE DEPARTING. Extra charges could be incurred if property is not left as agreed above and if there is any damage caused due to windows or doors being left open eg. change in weather and rain gets into property causing damage.

• Breakages, damage and losses are to be reported and paid for. If the cleaners report any losses from, or breakage, or damage to the property, it’s fixtures and fittings, the cost will be charged to you. Any damage you found upon arrival must be reported within 24 hrs of arrival so you are not held responsible.
• Lost keys may result in a minimum fee of $50 being charged. If you lock yourself out – $100 call out charge or locksmith (whichever costs more) will be paid by client.

Cancellation
• In unforeseen circumstances beyond the control of the Landlords/Owners: the Landlords/Owners reserve the right to cancel or alter booking arrangements. In the event of a cancellation the Landlords/Owners shall only be liable for the return of all money received.

• Cancellation Policy – if the booking is cancelled within 3 months prior to booking – $250 cancellation charge, within 2 months prior 10% of total booking will be charged plus $250 cancellation charge. Within 1 month prior loss of deposit. Less than 1 month prior 50% charged, less than 7 days 100% charged.

Insurance
• The Landlord agrees to insure the Property and, if he/she so wishes, the Landlord’s fixtures, fittings and effects, against such risks as are normally covered by a householder’s comprehensive policy.
• The personal effects of the Tenant will not be insured by the landlord.
• The Tenant shall not (nor allow others to) do anything that could adversely affect the Landlord’s insurance of the Property.

Force Majeure
No liability can be accepted by us where the contract is affected by ‘force majeure’. In the context of these terms and conditions, ‘force majeure’ is any event that we could not, even with due care, foresee or avoid. These events include but are not limited to war, threat of war, riot, civil commotion or strife, hostilities, industrial dispute, natural disaster, fire, acts of God, terrorist activity, nuclear disaster, adverse weather, government action, technical problems with transportation or other events outside our control.

Liabilities
We do not accept any responsibility or liability for acts of omission of third parties that may prevent or disrupt a guest’s booking. The information and descriptions supplied here are believed to be accurate and offered in good faith. Certain features or facilities may not be available from time to time due to circumstances beyond our control for which we accept no liability. In addition no liability can be accepted by us for any injury, loss or damage to the guest, any member of the guest’s party or any visitor to the rental property, arising out of or in connection with the use of the rental property.

Collection costs
If, at the end of the accommodation stay, there is an unsatisfied debt by way of Money Order, the client agrees that the client is liable for and shall pay for all costs of recovery of the Money Order, which costs shall be collected by a debt collection agency. Costs payable by the debtor shall include legal fees, commissions, fees and disbursements, and/or court filing fees and disbursements.

Agreement
The guest(s) agrees to be bound by these Terms and Conditions by paying the deposit, accommodation charges and security bond (as applicable) to Margay Property Management. Guest authorises Margay Property Management to charge guest credit card for additional cleaning, damages and associated collection costs.
